1. Introduction & Acceptance

Welcome to Infinite Q Graphics ("Company," "we," "our," "us"). By accessing our website, requesting a quote, or engaging our services, you ("Client," "you," "your") agree to be bound by these Terms and Conditions.

These terms constitute a legally binding agreement between you and Infinite Q Graphics. If you do not agree with any part of these terms, please do not use our services or website.

2. Services Provided

Infinite Q Graphics specializes in:

All services are provided on a project-by-project basis. Also - all graphic design projects (print ready files) excludes printing unless otherwise agreed upon in writing.

3. Client Responsibilities

To ensure successful project completion, the Client agrees to:

• Content Delivery: Provide all necessary content, copy, images, logos, and brand guidelines within agreed timelines.
• Timely Feedback: Review and provide feedback on deliverables within 5-7 business days. Delays may affect project timelines.
• Decision Making: Appoint a single point of contact for approvals to streamline communication.
• Access: Grant necessary access to hosting platforms, social media accounts, or CMS when required.
• Legal Compliance: Ensure all content provided does not infringe on third-party copyrights or trademarks.

4. Project Process & Timeline

Our standard project workflow:

Timelines provided in quotes are estimates and may be adjusted based on project complexity, feedback speed, and scope changes.

5. Pricing & Payment Terms

• Quotes: All quotes are valid for 14 days from the date of issue unless otherwise stated.
• Deposit: A 50% non-refundable deposit is required to commence work. This secures your place in our schedule and covers initial concept development.
• Final Payment: The remaining 50% is due upon completion and before final file delivery or website launch.
• Currency: All prices are in South African Rand (ZAR) and include VAT where applicable.
• Invoicing: Invoices are sent via email. Payment is due within 7 days of the invoice date.
• Late Payments: Projects may be paused on overdue invoices. Interest of 2% per month may be applied to outstanding balances.

6. Intellectual Property Rights

Before Final Payment:

Infinite Q Graphics retains full intellectual property rights to all concepts, drafts, and preliminary work. These may not be used, modified, or published without written consent and full payment.

After Final Payment:

Upon receipt of full payment, the Client receives:

• Exclusive ownership of the final deliverables (Logos; Flyers; Posters etc)
• Unlimited use for commercial and personal purposes
• Right to modify the final work (design skills recommended)

© Our Rights:

We reserve the right to:

• Display the project in our portfolio and social media
• Include the work in design competitions and publications
• Retain archive copies for record-keeping

If you require a non-disclosure agreement (NDA) or wish to exclude your project from our portfolio, please inform us before project commencement.

7. Revisions & Approvals

• Included Revisions: All projects include 2 rounds of revisions. Additional revisions are billed at our standard hourly rate of R450/hour.
• Scope Creep: Requests that significantly change the original project scope will be requoted as a separate project or phase.
• Final Approval: Written approval (email is acceptable) of final deliverables releases the project for final payment and file delivery.
• Corrections: Minor typographical errors will be corrected free of charge within 7 days of delivery.

8. Confidentiality

We take your privacy seriously. Infinite Q Graphics agrees to:

• Keep all client information, business data, and project details strictly confidential
• Never share your login credentials, passwords, or sensitive information
• Not disclose your project to third parties without your express permission (excluding subcontractors bound by the same agreement)

Our full Privacy Policy outlines how we collect, use, and protect your personal information.

9. Cancellation & Refunds

• Client-Initiated Cancellation: Deposits are non-refundable as they compensate for time reserved and initial work completed. Work completed beyond the deposit will be invoiced at our hourly rate.
• Company-Initiated Cancellation: We reserve the right to cancel a project with a full refund of any payments made if we determine the project scope exceeds our expertise or conflicts with our values.
• Refunds: Due to the custom nature of our services, refunds are not issued for completed work or digital deliverables.

10. Website and System Development Specific Terms

Hosting & Domain:

• Website and System application hosting and domain registration are separate services billed annually unless included in a maintenance package.
• We recommend reputable providers and can assist with setup, but accounts must be registered in the client's name.

Maintenance:

• Optional maintenance packages are available for security updates, backups, and technical support.
• Without an active maintenance agreement, websites ans system application are delivered "as-is" and ongoing updates are billed hourly.

Browser Compatibility:

• We test websites on current versions of Chrome, Firefox, Safari, and Edge.
• Internet Explorer 11 and older browsers are not supported.

SEO:

• Basic on-page SEO is included. Guaranteed search engine rankings are not provided.

11. Third-Party Services

Our projects may utilize third-party tools, plugins, stock imagery, and fonts. The client is responsible for:

• Purchasing appropriate licenses for stock images, fonts, or premium plugins
• Adhering to the terms of service of third-party platforms (Shopify, WooCommerce, WordPress.org, etc.)
• Ongoing subscription costs for software or services

We will clearly outline which third-party assets require purchase and any recurring fees.

12. Limitation of Liability

• Infinite Q Graphics shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services.
• Our maximum liability shall not exceed the total amount paid by the client for the specific project giving rise to the claim.
• We do not guarantee that our websites will be error-free, uninterrupted, or permanently secure.

13. Indemnification

The Client agrees to indemnify and hold Infinite Q Graphics harmless from any claims, damages, or expenses arising from:

• Content provided by the client that infringes on third-party copyrights or trademarks
• Client modifications to the final deliverables after project completion
• Use of the final product in violation of applicable laws

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms shall be resolved in the courts of 408 Ga Dikgale, Polokwane, Limpopo, South Africa.
